Terms of use and safety — Mimesis

1. Agreement

By installing or using Mimesis you agree to these terms and to the privacy policy (shown in the app). If you do not agree, do not use Mimesis.

2. Who may use Mimesis

You must be at least 13 years old. If you are under 18, read these terms with a parent or guardian.

3. Use it safely

• Do not read subtitles, type, or look at the screen while driving, cycling, walking in traffic, operating machinery, or doing anything else that needs your attention. Listen only when it is safe, and follow local laws about phones in vehicles.
• Keep the volume at a safe level, especially with headphones, and stay aware of your surroundings.
• Take regular breaks from the screen for your eyes and posture.
• Mimesis is not an emergency service.

4. Your license to use Mimesis

We give you a personal, non-exclusive, non-transferable, revocable license to use Mimesis on devices you own or control, under these terms. You may not copy, resell, or redistribute the app, or reverse engineer it except where the law allows. Open-source parts are covered by their own licenses (listed in the app).

5. Your data and content

Your clicks, memos, words, playlists, and notes are yours. NeuroPhonetics does not store them: they stay on your devices and in the accounts you connect, and we cannot see or recover them. When you choose to copy, sync, export, or share them (Google Drive, a synced folder, Readwise, Anki, Obsidian, Logseq, email, or any other app), that copy is handled by the service you chose, and you are responsible for it and for your backups.

6. Acceptable use and copyright

• Use Mimesis lawfully and only with content you are allowed to play.
• Transcripts, subtitles, and audio belong to their owners. Saved clicks, excerpts, exports, and subtitle files you export (including subtitles with IPA) are for your personal study; do not republish, upload, or sell them.
• Audio you cut, share or send is your responsibility. Cut and share only audio you have the right to use — your own recordings, podcasts for your personal study, files you own. Mimesis doesn't check where audio comes from. Never cut YouTube or protected audio. Clips you make with "Share this clip", "Send to Antiphon" or the clips export are for your personal study; do not redistribute them.
• Exports carry a short line, "Made with Mimesis · NeuroPhonetics.com". You may remove it from your copy.
• If you believe something in Mimesis infringes your rights, contact us at the address below.

7. YouTube and other services

• Mimesis plays YouTube videos with YouTube's player. By using that part of Mimesis you agree to the YouTube Terms of Service (https://www.youtube.com/t/terms) and your data is handled under the Google Privacy Policy (https://policies.google.com/privacy).
• What Mimesis plays from YouTube depends on YouTube and may stop working at any time.
• Podcast feeds, Google Drive, Readwise, Obsidian, Logseq, AssemblyAI, Groq, and other services you connect have their own terms and privacy policies. Costs of services you connect with your own account (for example online transcription) are yours.
• Pronunciations (broad IPA) come from the family's one table in the NeuroPhonetics kit, written by the engine of Phonema, our IPA app, from the word list of the CMU Pronouncing Dictionary, © Carnegie Mellon University, used under its license and provided by its authors "as is". Narrow IPA comes from the Phonema app and its service, under Phonema's terms.
• Google Play's terms apply to downloading Mimesis and to purchases; Google is not responsible for Mimesis.

8. Purchases

If Mimesis offers a one-time Pro unlock, it is sold and refunded through Google Play under Google Play's policies. The unlock gives access to the Pro features in the version of Mimesis you have; it is a one-time purchase, not a subscription, and not a promise of future features, updates, or support.

9. Current version, changes, and ending the service

You get Mimesis as it is when you install or buy it. We do not promise updates, new versions, new features, support, or that it will keep working on future versions of Android or on new devices. We may change, pause, or stop Mimesis or any feature at any time, including stopping updates or support, with notice where reasonably possible. Mimesis may stop working because of changes to Android, Google Play, devices, or third-party services we do not control. We have no obligation to keep Mimesis available, compatible, or updated. Because your data stays on your devices and accounts, keep your own backups and exports.

Test versions (internal, closed, or open testing on Google Play, or installed directly) are unfinished: they may have bugs, lose or damage data, stop working, or be removed without notice. Use them only with data you have backed up.

10. No guarantee of results; not professional advice

Mimesis is a listening and study tool. We do not promise that it will improve your language skills, memory, or learning, or that it suits any particular purpose. Subtitles, automatic translations, transcriptions, and pronunciations (IPA) may contain mistakes. IPA shows one common American pronunciation from a dictionary and rules; real speakers, accents, and words in context may differ, and some words have no IPA. Mimesis is not professional, educational, or medical advice.

11. Disclaimer of warranties

Mimesis is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.

12. Limitation of liability

To the fullest extent permitted by law, NeuroPhonetics LLC, a limited liability company registered in the State of Minnesota, United States, and its owners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss, corruption, or exposure of data (including data in folders, accounts, or services you choose), profits, or goodwill, injury, accidents, or distraction, arising from the use of, or inability to use, Mimesis. Our total liability for any claim is limited to the greater of the amount you paid for Mimesis in the 12 months before the claim or US$10. Some places do not allow these limits; there, they apply only as far as the law allows. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

13. Your responsibility to us

If you use Mimesis unlawfully or break these terms, and that leads to a claim against us, you agree to cover the reasonable costs and damages that result, as far as the law allows.

14. Governing law and disputes

These terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Minnesota, except that either side may use small-claims court. If you are a consumer, you keep any mandatory rights that the law of the country where you live gives you.

15. General

• These terms, together with the privacy policy, are the whole agreement about Mimesis.
• If a part of these terms is invalid, the rest still applies.
• Not enforcing a part of these terms is not a waiver of it.
• You may not transfer these terms; we may transfer them, for example if Mimesis gets a new owner.
• We may send notices inside the app, on NeuroPhonetics.com, or by email if you gave us one.
• Suggestions you send us may be used freely, without payment or obligation.
• If a translation differs from the English version, the English version applies.

16. Changes to these terms and contact
